This website is owned and operated by Wadi Rum Fire Camp, which is known as (Nomade) or under the subsidiary company Sea Gypsies Travel Sdn Bhd. By accessing this website and its associated services, you accept our Terms and Conditions. Please read our terms and conditions carefully, and cease usage of this site immediately if you do not agree with these terms. In these Terms, ‘us’, ‘we’, and ‘our’ denote Nomade.

Nomade is a web-based marketplace that enables transactions between site users (Travellers) and designated third-party service providers (Local Operators) by enabling them to promote their offerings (Services) via tickets for specific experiences and allowing travellers to reserve these Services.

1. Scope of Access

1.1. The website, Nomade provided on our website is a summary and does not constitute a comprehensive overview. While we strive to assure the accuracy of the information presented, we do not guarantee its correctness to the fullest extent allowed by law. We disclaim all responsibility for interference with or damage to your computer systems resulting from your use of this website, Nomade or any associated websites.

1.2. In order to provide the services travellers have requested, the website Nomade may use and process travellers personal data for the following purposes (the Purposes): managing your reservations for your stay and travel with us, as well as your participation in activities, tours, or trips that we have organised; and for billing and payment purposes pertaining to the services you have requested.

1.3. We, Nomade shall exert diligent efforts to ensure that the transportation, accommodation, meals, and other agreed-upon services (hereinafter referred to as the “Services”) provided are fully in accordance with the services that the company Nomade has contracted to deliver. However, the local operator’s liability for breach of contract is limited to cases of negligence by them or their employees or agents, which result in the failure to deliver all or part of the services. In the event of a failure to deliver the contracted service, Nomade reserves the right to substitute equivalent services or issue a refund, subject to availability.

1.4. We may promote Nomade and enhance the visibility of adventures among prospective travellers. We may feature our products on external websites, within applications, in emails, and across both online and offline advertising channels.

1.5. To facilitate travellers who communicate in various languages, their adventures may be translated, wholly or partially, into other languages. We do not warrant the precision or quality of these interpretations; travellers are responsible for reviewing them and validating these accuracy.

2. Further Rights of Products

2.1. The website Nomade reserves the right to withdraw, modify, or discontinue any travel products (or any part thereof) at any time and without prior notice. Any traveller acknowledges that we shall not be liable to any other party for any modifications, cancellations, or discontinuations of the travel products.

3. Usage of Platform

3.1. All personal data are confidential and non-transferable and will be promptly disposed of once no longer necessary in accordance with the statutes of each respective country.

3.2. By communicating with us, engaging with our services, or utilising our services, travellers acknowledge that have read and understood this notice and consent to the use, processing, and transfer of their personal data by the Nomade, as outlined herein.

3.3. Any traveller may secure a tour reservation by following the booking procedure in accordance with any requirements set forth by Nomade. All applicable fees and taxes(Total Fees) shall be disclosed prior to the completion of the booking. Upon receipt of a booking confirmation and payment from Nomade, the transaction shall be deemed successful unless otherwise specified in the product details or terms.

3.4. In the event that Nomade has not received a complete payment, we reserve the right, at its sole discretion, to withhold all or any portion of the services immediately without notification. Additionally, Nomade shall have the right to collect the outstanding amount directly from the travellers and to recover all applicable cancellation fees in accordance with the relevant product or terms, nor be obligated to notify the travellers in advance, including the possibility that the services or experience or any part thereof may be withheld.

3.5. We, Nomade reserve the right, at our sole discretion, to refuse or decline any booking or reservation if the desired availability is not confirmed or sold out. Travellers are responsible for their travel arrangements and any associated appointments or reservations that result from such planning. If you book or reserve a (Travel Product)that is unsuitable or falls outside the scope of our authorised tour offerings, we will not be responsible for or facilitate any refunds. We will forward any special requests you may have to the appropriate partner. However, such requests cannot be guaranteed and are subject to approval on a case-by-case basis. Unless otherwise specified, all appointments or reservations are non-transferable.

3.6. As certain products listed on our website are provided by (Local Suppliers) and are subject to their respective terms and conditions. For such products, Nomade functions solely as an electronic and online booking platform for the (Travel Products) offered by the suppliers and shall not be held responsible or liable for:

(1) cancellations requested by the customer, misinformation, or mishandling of any booking or reservation by the Suppliers;

(2) any other dissatisfaction or complaint concerning the quality of the Travel Products provided by the Supplier; 

(3) any damage to or loss of personal property, or personal injury, regardless of how it is sustained or caused; or 

(4) customer itineraries that are unrelated to our offerings.

3.7. Travellers shall bear sole responsibility for any modifications made to a booking via our website and agree to assume any applicable additional fees and/or taxes resulting from such booking alterations.

4. Cancellations and Refunds

4.1. Any force majeure or certain unforeseen circumstances may occur, including but not limited to weather events, pandemics, quarantines, border closures, actions by governments or authorities, wars, hostilities, political upheavals or civil unrest, riots, strikes, terrorist activities or threats thereof, criminal acts by third parties, vehicle defects or equipment failures, or acts of God, which are beyond anyone’s control and may result in the cancellation or disruption of services. These circumstances shall be considered force majeure events. We shall not be held responsible or liable in any manner for such events, including mortality, bodily injury, illness, damage, delay, or other losses resulting from such events. Although we will continually endeavour to support our travellers regardless of their location when such circumstances arise, any losses or expenses incurred as a result of these events shall be borne by the traveller.

4.2 Nomade strictly adheres to a non-refundable policy for all tours that are reserved. Following the confirmation of a booking and the submission of payment, no refunds will be issued for any personal reason, including but not limited to cancellation, no-show, late arrival, travel disruptions, or personal emergencies. This no-refund policy is acknowledged and agreed to by proceeding with a booking.

4.3. Any request relating to a booking (e.g., changes to dates, room type, itinerary, or special accommodations) must receive prior written approval via email from Nomade. Our approval is reliant upon our sole discretion and a case-by-case basis. Verbal requests or requests made through third parties are not legally binding. A reply email will be sent to confirm approval, and not all cases are guaranteed. the communication is considered final once it is responded to, regardless of whether it is approved.
 

4.4. Travellers understand that journeys, especially those to overseas and isolated locations, may carry certain risks. The extent and character of personal risk involved are contingent upon the specific products or services provided and the geographic regions in which they are delivered. Participation in physical and/or high-risk activities, such as ziplining, snorkelling, or hot air ballooning, as well as travel by watercraft or journeys to high-altitude locations, remote areas, or countries with developing infrastructure, may entail a considerable level of personal risk. The standards of hygiene, accommodation, and transportation at certain destinations we visit are often lower than what one might expect in their home country, and there is a potential risk of food poisoning, illness, or injury.

4.5. By reserving with us, travellers acknowledge that they have evaluated the potential risks, hazards, and challenges, as well as their own personal capabilities and needs, and assume responsibility for all such risks. Travellers should take all necessary precautions to ensure their safety during their journey, which includes, but is not limited to, properly using safety equipment (such as seatbelts, harnesses, flotation devices, and headgear) and following all posted signs and verbal or written safety instructions. In the absence of negligence on our part, Nomade shall not be held liable for any claims or causes of action arising from losses, damages, injuries, or fatalities resulting from non-compliance with safety instructions or warnings, as well as the inherent risks associated with travelling and participating in adventurous activities included in our itineraries or otherwise organised by us or our local partners.

4.6. Travellers are permitted to cancel a confirmed reservation at any time in accordance with the product cancellation policy. However, Nomade will not process refunds nor exchange the voucher in the event that travellers withdraw from participation. 

4.7. In the event of unforeseen circumstances or adverse weather conditions that render the situation unsafe or unsuitable for travellers, the local operator or Nomade reserves the right to modify or terminate a confirmed booking in accordance with our cancellation policy. The traveller will be entitled to a full refund of the fees paid for the ticket due to force majeure events under the local operator or Nomade’s fault.

4.8. Neither Nomade nor the local supplier will be responsible for any losses incurred as a result of changes to the travel product’s pricing, route, schedule, or itinerary caused by unforeseen events or situations beyond our control.

5. Safety & Ethical

5.1. Travellers must not do any act we deem inappropriate, unlawful, or prohibited by applicable laws, including breaches of an individual’s privacy or other legal rights.

6. Final Provisions

6.1. We, may change these terms and conditions. Continued use of our website signifies acceptance of the updates
